Topic: Selective Enforcement of Property Rights: Comparative Studies of American Indians and Chinese Villagers

Abstract: Conventional thinking is that establishing private property rights contributes to prosperity. But a case can also be made that increasing value of property rights results in property insecurity for some. We use evidence from Native Americans in the United States and rural households in reform-era China to show that as each country became more prosperous, the government provided property protection selectively. In the United States during the nineteenth century, settlers received complete and alienable private property rights, while indigenous people were forced into an inequitable, inflexible property regime that exists well into the twenty-first century. In reform-era China, rural residents have been consistently discriminated against to ensure there is enough land for industrialization and urbanization. We use the theory of selective enforcement of property rights to explain this and argue that selective enforcement is the logical starting point for analyzing property regimes.
